Debt Collector Harassment

Debt collectors are required to follow the Fair Debt Collection Practices Act (FDCPA). They are not allowed to harass you about your debt, threaten you, or misrepresent anything about the debt. Contact this office to make sure that they follow the FDCPA. Successful plaintiffs can get $1,000 in statutory damages plus any additional actual damages suffered as a result of the activity.

Unwanted Phone Calls

According to the Telephone Consumer Protection Act (TCPA), creditors and debt collectors are not allowed to call your cell phone with an autodialer without your consent. Damages for TCPA violations can be up to $1,500 per unwanted call.

Credit Report Investigation

Debt collectors and creditors have a duty to correctly report debt on your credit report, and to mark disputes appropriately. If they are not doing this, they may be violating the Fair Credit Reporting Act (FCRA). If you see things on your credit report that aren’t supposed to be there, then contact this office and we will help.
